permits that allow qualified foreigner to work in the United States.
The strength of U.S. companies lies largely
in the quality of their employees. Many U.S. employers actively
recruit worldwide for professional talent. The H1B Visa
(Professional in a Specialty Occupation) allows a U.S. employer to
fill a position requiring the minimum of a baccalaureate in the
particular field with a qualified worker from abroad.
Who is eligible to apply it?
The H-1B nonimmigrant visa may be issued to
individuals who seek temporary entry in a specialty occupation as a
professional. Some examples of "specialty occupations"
include accountant, computer analyst, engineer, financial analyst,
scientist, architect or lawyer. The petition can be approved with a
combination of college or university course work plus three years
work experience for each year of university education missing.
Together this would be deemed equivalent to a four-year bachelor's
degree.
Thus, there are two requirements: First, the
employer must demonstrate a need for someone in a specialty
occupation as the minimum capability to perform the job; and second,
the foreign national must have the required degree, or its
equivalent, in a subject closely related to the position.
